Erickson falsely claims that IRS "leak" was malicious and intentional

The false narrative about National Organization for Marriage's 2008 donor schedule continues. According to Erick Erickson:
We now know that some person or persons at the IRS intentionally and maliciously leaked confidential tax records of a non-profit organization so that gay rights activists could target the donors of the organization for harassment.

We know nothing of the sort. What we do know is that a low-level employee at the IRS failed to provide a copy of NOM's 990 to Andrew Meisel with the donor names removed. We know that Meisel offered the document to the Human Rights Campaign after the fact. We also know that, in summary judgment, the court ruled that there was no evidence to support the claim that this was malicious or intentional. NOM lost this case.

Erickson's link, by the way, is to the Daily Signal which is Heritage Foundation's propagandist blog. Oddly enough, Erickson's piece is about the lack of intellectual honesty in mainstream media. Erickson claims to want to know why the press has not inquired about Eric Holder's lack of prosecution in this matter. How about the fact that there is nothing to prosecute? Stupidity is not a felony and stupidity is all that happened here. It was a clerical error.

Were Erickson anything more than a hack, he would review all of the court filings rather than rely on a Heritage blog. The filings are online. He would then honestly report what happened. He would then be free to opine as he chooses but there is only one set of facts. Nevertheless, Mr. Erickson is a hack and a right wing political operative with an agenda.
