Liberty Counsel needs adult supervision - and overdue sanctions

They might be religious crackpots but every attorney at Liberty Counsel has met the requirements to become a member of the bar. They have a client who is in contempt of court on the advice of Liberty Counsel (an anti-gay hate group). This makes attorneys at Liberty Counsel – who are officers of the court – subject to charges of misconduct and even disbarment.

Before Judge Bunning at the federal district court issued his temporary stay, Kim Davis was in contempt of court. She was refusing to issue marriage licenses despite the court ordering her to do so. Now the Sixth Circuit Court of Appeals has denied Ms. Davis a stay (see below) while her appeal is being considered. This vacates Judge Bunning's temporary stay which was to expire on Monday. It is worth noting that the stay was principally denied due to the improbability of Davis to prevail.

Ms. Davis has not, and claims that she will not, obey the court. She is apparently holding out for the Supreme Court to weigh in. It doesn't work that way. First of all she has an appeal in progress with almost no probability that the Supreme Court is going to weigh in. Secondly, she is in contempt of court if she refuses to issue marriage licenses. I hold Liberty Counsel responsible for this lawlessness.

This is hardly the first time. As far as I am concerned Mat Staver was complicit in a parental kidnapping to Middle America in order for LC's client to disobey a court order. We are not a theocracy. Staver's superstitions do not supersede valid laws. It is time for the courts to take appropriate actions.
