On behalf of the gay community I want to apologize to Gary Cass

I am truly sorry Mr. Cass. You should have been consulted before the Supreme Court issued its ruling in Obergefell v. Hodges. This becomes even clearer from today's email from Mr. Cass titled “Rescuing Marriage: Now or Never?” It makes me sad because now he has to raise all that money to do an undo.

Cass' little hate group is the Christian Anti-Defamation Commission. He resolutely believes that he has the idea to thwart the baddies at the Supreme Court and upend the ruling in Obergefell. He started nullifyit.com. According to Cass:

Nullification is the legal theory that asserts a state has the right to nullify federal law which that state has deemed unconstitutional or beyond the constitutional powers of the federal government.
That's pretty much a Wikipedia cut-and-paste but he left out this part: “The theory of nullification has never been legally upheld by federal courts.”

Indeed, as I have pointed out before this was resolved by the Supreme Court in Cooper v. Aaron when the Arkansas legislature passed a law to perpetuate segregation in an attempt to nullify Brown v. Board of Education. The Court held that Brown was the law of the land because the Supremacy Clause of Article VI made the US Constitution the supreme law of the land and Marbury v. Madison made the Supreme Court the final interpreter of the Constitution.

Cass attempts to make a Tenth Amendment argument. However, a state cannot interfere with the constitutional rights of citizens. The Supreme Court has determined that gay citizens have the right to marry. It is all pretty simple — unless you are Gary Cass and you do not like same-sex marriage. And Mr. Cass abhors same-sex marriage.

All this to make videos for a website pushing an idea that is illegal and unconstitutional. “Sorry kids. No toys this year.” With all of these Christians opposing same-sex marriage, surely they can come up with the margins required for a constitutional amendment. Maybe not. The fact is that a majority of the public supports same-sex marriage. Even where there has been some resistance, most marginally sane people realize that it has no effect on them or their traditional marriages.

The legal name of Cass' operation, according to the IRS, is Christian Anti-Defamation League CADL. Originality is not one of Cass' long suits. Based in Vista, CA they took in about $166,000 in 2013 and spent $161,000. Cass takes a salary of $84K plus whatever he grabs from those “Other Expenses.” Cass is even nuttier when it comes to Muslims. Apparently the defamation of other religions is part of defending Christianity.

Cass claims to have a PhD from Westminster Theological Seminary. That school's accrediting agency is not recognized by the US Department of Education. You can draw your own conclusions.
