Just looking through the table of contents it seem unlikely that Staver & Co. will prevail. It is a motion for a summary judgment in their favor. For a summary judgment there have to be no contested issues of fact. The judge is left with a decision based on the law. There seem to be many issues of fact that are left to resolve. This, by the way, is the 257th document on the docket.
