A couple of important reads on Title VII

On Tuesday, Will Baude previewed Hively v. Ivy Tech Community College. The case asks whether Title VII of the Civil Rights Act of 1964 already provides federal nondiscrimination protection to gays on the basis that anti-gay discrimination would constitute discrimination on the basis of sex.

Today Baude follows up with a review of oral arguments before the Seventh Circuit on Wednesday. For LGBT citizens this is probably the most important case making its way through the courts since Obergefell v. Hodges

A recording of the oral arguments is here.

Baude is an assistant professor of law at the University of Chicago Law School. In spite of his official position in the food chain, he holds an endowed chair. Because he writes for Volokh, he is presumed to be a right-leaning libertarian.
