Mat Staver: "Merry Fucking Christmas"

Mat Staver of Liberty Counsel chose December 26 to spout some anti-LGBT bigotry demonstrating, yet again, why the organization is designated a hate group. At issue is a frivolous lawsuit filed by Texas AG (and certifiable whack job) Ken Paxton  and the Becket Fund for Religious Liberty. They are attempting to overturn Section 1557 of the Affordable Care Act which bars discrimination by health insurance companies and medial practitioners accepting federal funds.

At the core of their argument is the idea that all doctors are compelled to perform sex affirming surgery or provide hormone therapy upon request even if they have a religious or professional objection to doing so. Does that include my urologist? Podiatrist? It is an absurd argument because the only people qualified to treat people with gender dysphoria are specialists who are trained to do so. Obviously they have no objections. According to Moronic Mat:
Eight states and several faith-based organizations presented oral arguments in Texas federal court challenging an Obamacare regulation forcing all doctors and staff perform “gender re-assignment” surgeries and hormone treatments on patients, even children. The December 20, 2016, arguments focused on their request for a preliminary injunction. The Department of Health and Human Services intentionally refused any religious exemptions, despite dozens of requests and essentially is demanding faith-based organizations and religious people bow to LGBT demands.
The intended inference is that children are candidates for surgery which is incorrect. Yet, this argument could prevail given the locale of the court. Staver continues:
This mandate forces doctors to break their Hippocratic Oath of “Do no harm” and demands doctors and staff actively participate in, and cause, something that deeply opposes their religious beliefs. It ignores the inherent risks of unnecessary surgery, especially with regard to children. In Liberty Counsel's memo, evidence shows that most children who claim to identify as another gender before puberty outgrow that perception by the time they become adults. In addition, two-thirds of patients experience at least one other simultaneous psychiatric issue.
This is partially anti-abortion boilerplate and now directly states — inaccurately — that children are candidates for gender affirming surgery. Then they repeat the claim that most children outgrow their discomfort which is possibly true but irrelevant. It is also true that many transgender people experience mental health issues. According to experts this is due to Minority Stress syndrome to which Mr. Staver is a rabid contributor. It is also irrelevant to the issue. Staver doesn't know the difference between the Hippocratic Oath and a hippopotamus.

It is horrific that our government is trying to bully every practicing surgeon in America to cut and carve people, even children, based on a tenuous whim or wish. Our First Amendment protects everyone, even doctors, from being forced to take disastrous actions opposing their religious beliefs. These patients, and especially children, need to find a safe environment to address the roots of their desire for sex-change surgery. Oftentimes, surgical mutilation does nothing to heal the hurt and heart of the matter. These people need to be lovingly counselled , not cut up.
Staver is in no position to weigh in on the medical treatment of people with gender dysphoria. Most of this is irrelevant but, given the opportunity, Staver is always up for some bigotry towards — and misinformation about — LGBT people. He is confining the issue to surgeons. However, again, the only surgeons who perform gender affirming surgery are those who want to perform the procedure. Otherwise they would not have opted to be trained to do so in the first place.

I suspect that this case is being heard in Texas because the Becket Fund solicited Paxton to be the lead plaintiff for the purpose of obtaining the most favorable jurisdiction. The entire matter seems preposterous.
