For American Family Association and Family Research Council not much has changed over the last 15 years. On January 16, 2002 the U.S. Court of Appeals for the Ninth Circuit ruled that the City and County of San Francisco did not violate the Constitutional rights of conservative Christians.

American Family Association, Donald E. Wildmon, Kerusso Ministries and Family Research Council appealed the  dismissal of their case at the district court. They alleged that the City and County of San Francisco violated the First Amendment and the California constitution by formally disapproving of an advertising campaign that espoused the view that homosexuality is a sin and that homosexuals could be cured. The court of appeals affirmed the lower court's ruling.
