Transgender rape conviction has no bearing on public policy

In Wyoming a transgender woman, Michelle Martinez, has been convicted of sexually abusing a 10-year-old girl. It is a horrible crime and the perpetrator should be harshly punished.

This will start to bounce of the walls of the right wing echo chamber with Christians asking, rhetorically: “Isn't that what we have been saying all along?” The answer to that question is a resolute “No.” What they keep insisting is that men will pretend to be transgender to have access to women's facilities. Just today there is an example of that from Tami Fitzgerald, executive director of the North Carolina Values Coalition.

Fitzgerald is a five-watt bulb. According to her (according to the hate group American Family Association):
Worst of all, Fitzgerald says it is a betrayal of women and girls who are using private facilities, as they might be harmed by a man who claims to be transgender in order to gain entry to those facilities.
A helicopter might land on the roof of my building piloted by a god who showers me with U.S. currency. People do not pretend to be transgender to harm women in public facilities. It just doesn't happen.

Aside from the fact that Martinez actually is a trans woman, she was a friend of the family and the incident occurred at the child's home. The bottom line is that this has no bearing on public policy. Were that the case we would have to outlaw Christian youth counselors who have racked up a pretty impressive record for child abuse. The overwhelming majority of child abusers are heterosexual, cisgender males.

Nurses at the Wyoming Medical Center completed a sexual assault exam and found redness and abrasions on the girl's genitalia. I would hope that Martinez received a fair trial. Allegations of child sexual abuse can produce a reaction bordering on hysteria. Add a transgender woman to the mix and some questions need to be asked.
