Got that one wrong - California baker gets a pass

Our brainless baker
California Superior Court Judge David R. Lampe has agreed with Catholic warrior, attorney Charles LiMandri. Lampe has ruled that a California baker, Cathy Miller, owner of Tastries in Bakersfield,  has a right to discriminate. Lampe refused to issue an injunction prohibiting the baker from discriminating in defiance of state law. The Washington Post points out:
“A wedding cake is not just a cake in a Free Speech analysis,” wrote Superior Court Judge David R. Lampe in a decision late Monday. “It is an artistic expression by the person making it that is to be used traditionally as a centerpiece in the celebration of a marriage. There could not be a greater form of expressive conduct,” he said.
The centerpiece nonsense parrots an assertion made by the baker's lawyer. How the cake is used is not the test of expressive conduct. Making this even more infuriating is that the lesbian couple did not want any words on the cake, just the cake.

This case will probably be appealed.
