The Holier-Than-Thou Crowd and Tax Obligations

AFA Action is American Family Association's 501(c)4. It can engage in political activities but donations are not tax deductible. Regardless of the deductibility of donations, we all subsidize AFA Action. If it has revenues in excess of expenses, the surplus is not taxed enabling it to accrue assets that can be used to persecute LGBTQ people (AFA is an anti-LGBT hate group).

Please bear with me. The Internal Revenue Service last updated the source for my nonprofit database (the Business Master File or BMF) on June 10, 2019. As of that date, the most recent tax return for AFA Action was filed for calendar year 2015 which means that it has not filed for two years in a row (2016 and 2017). Indeed, 2015 is the most current return that Guidestar can provide and it is not marked as a final return which is obvious since it remains in the BMF.

In spite of our subsidy, AFA Action is hiding two years of its operations. I have to wonder why.

The most current tax return for American Family Association, for the fiscal year ended June 30, 2018, can be found at the New York AG charity registration website. There are several errors on the return including the absence of Schedule R listing related organizations. On part IV line 34 AFA indicated that it has no related organizations. That is clearly untrue. AFA Action has overlapping directors and officers. It shares the same PO box with AFA.

The New York AG has AFA's audited financial statements and the most recent 990 has detail beyond anything required by the Service. These depict sophisticated financial disclosures. At any time AFA Action could have filed a final return. It has not which is why it is still in the Business Master File.

It is reasonable to assume that AFA is deliberately obfuscating the activities of AFA Action. They have all of the benefits of a 501(c)4 affiliate without providing any of the disclosure.

American Family Association is an anti-LGBT hate group. AFA presumes to be the arbiter of what is moral and immoral. Their judgment is augmented by petitions and boycotts. Not meeting legal and civic responsibilities is immoral but AFA doesn't see it that way. I suspect that the IRS will have a different perspective.
