Federal Magistrate Shreds ADF's Anti-LGBTQ BS

Thursday, a federal magistrate has recommended dismissal of a suit brought by an Ohio professor who refused to use gender correct pronouns at work.

Nicholas K Meriwether is one of those odd creatures who becomes a hero to the religious right for his belligerence and lack of respect for others due, pro forma, to his Sincerely Held Religious Beliefs™. His SHRB would, of course, be defended by a hate group, Alliance Defending Freedom.

It is my SHRB that veal osso bucco is holy manna. But I digress.

Mr. Meriwether, you see, is a professor at Shawnee State University in Ohio. Meriwether has determined that he cannot address a student according to her requested pronouns (she is a transgender woman). He has already addressed her in front of classmates with “yes, sir.” Eventually, he received a written warning. If he does it again he will likely be terminated.

It has been my experience that no one is ever at fault for workplace discipline. Mr. Meriwether is no exception. Last November, with the help of ADF, he sued the university, accusing it of impermissible viewpoint discrimination, religious oppression, violation of due process and a host of other offenses that made Jesus and Moses weep.

In prayer last night, God told me that she is planning a comet strike on the university but she refused to tell me when that might happen.

Sarcasm aside, this is a very serious matter. We do violence to transgender people by misgendering them. It is hurtful and it is entirely unnecessary. Even if one holds the view that transgender people do not really exist, there is no reason to not address people as they choose to be addressed in conformity to the generally accepted rules of civility in polite society.

In other words, this is deliberate crassness.

The rude Nicholas Meriwether has professional victim status among anti-LGBTQ hate groups. Chris Woodward, one of American Family Association's paid boobs, wrote:
In January – during a political philosophy class he was teaching – Meriwether responded to a male student's question by saying, "Yes, sir."
Yessiree, let's play along and claim that there is no such thing as gender. Who's to know the difference?

Hate group leader Tony Perkins (Family Research Council) penned some blather titled: Mind-boggling: Prof refuses to call male student ‘ma’am,’ may get fired. Perkins then manages to misspell Nicholas. Just a few days ago, ADF's Travis C. Barham claimed in an essay that requiring faculty to be kind to students (which is what this is all about) stifles academic freedom.

LifeSiteNews had the same take. According to their Calvin Freiburger:
A college professor who refused to indulge a male student’s desire to be considered a female is taking university officials to court in a bid to clear his record.
What is so fucking difficult about conforming to workplace policy, politeness and medical science?

The magistrate's report and recommendations is a lengthy read but well worth your time. In brief she has determined that Garcetti v. Ceballos applies. In that case, the Supreme Court ruled that workplace speech by government employees is not protected by the First Amendment. ADF tried to get around this by claiming that the speech was as a private citizen addressing a public concern. The magistrate wasn't buying any of that BS.

There are many other citations, of course but it is worth noting the second reason for recommending dismissal. Meriwether (ADF) failed to provide evidence to support any of their claims.

The judge hearing this case is Susan J. Dlott, a Clinton appointee. Dlott assumed senior status in May of 2018. Nothing is ever certain and ADF will certainly file an objection but I expect that she will accept the magistrate's recommendations. Of course if they lose ADF will go to the United States Court of Appeals for the Sixth Circuit.

The good news is that, while this is in process, Nicholas Meriwether must adhere to the policies of the university which prohibit him from mistreating LGBTQ students.
